Terms of Service

Kitsunoko provides a subscription-based platform that aggregates and scores product trend data from publicly available signals including Google Trends, retail marketplaces, and social platforms. The Service is designed to help independent sellers and dropshippers identify potentially trending products for research purposes.

The Service provides information, not financial advice. Scores, decisions (GO DEEPER / MONITOR / PASS), ROI estimates, profit projections, and supplier data are algorithmic outputs intended for research only. They do not constitute investment, financial, legal, or business advice. You are solely responsible for your sourcing and business decisions.

You must be at least 18 years old and capable of entering a legally binding agreement to use the Service. By registering, you represent that all information you provide is accurate and that you will keep it current.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at legal@kitsunoko.com if you suspect unauthorized access.

One account per person. You may not share, sell, or transfer your account to another party.

Kitsunoko offers a free tier and paid subscription plans (“Pro”). Paid plans are billed monthly or annually as selected at checkout. All prices are in US dollars and exclude applicable taxes.

Free trial. Pro plans include a 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your selected payment method will be charged the applicable subscription fee.

Cancellation. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain access to paid features until that date. We do not provide prorated refunds for partial billing periods except where required by law.

Refunds. If you experience a material service failure that we cannot resolve within 72 hours of a reported issue, you may request a refund of the most recent billing period by emailing legal@kitsunoko.com. Refund decisions are at our sole discretion beyond this window.

We reserve the right to change pricing with 30 days’ advance notice. Continued use of the Service after the effective date of a price change constitutes acceptance.

You agree not to:

• Scrape, crawl, or systematically extract data from the Service by automated means
• Resell, redistribute, or sublicense access to any data or features of the Service
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use the Service to build a competing product or service
• Share your account credentials or allow others to access the Service through your account
• Violate any applicable law, regulation, or third-party right in your use of the Service
• Upload or transmit malicious code, spam, or any content that interferes with the Service

We reserve the right to suspend or terminate accounts that violate these rules without prior notice and without refund.

The Service, including all software, designs, scoring algorithms, data compilations, and written content, is owned by Kitsunoko and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any ownership interest in the Service.

You retain ownership of any content you submit to the Service (such as saved product lists or account preferences). By submitting content, you grant Kitsunoko a non-exclusive, royalty-free license to use that content solely to operate and improve the Service.

Our collection and use of your personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

The Service integrates with or displays data sourced from third-party platforms including Google, Amazon, TikTok, Reddit, and others. Kitsunoko is not affiliated with or endorsed by these platforms. Third-party data is provided “as is” and we make no representations about its accuracy, completeness, or fitness for a particular purpose.

The Service may contain links to third-party websites. We are not responsible for the content or practices of those sites.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, KITSUNOKO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that any specific result will be achieved from use of the Service. Product trend data and scoring outputs reflect historical and real-time signals — they are not predictions of future performance.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KITSUNOKO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $50 USD.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY. IN THOSE JURISDICTIONS, LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

You agree to indemnify, defend, and hold harmless Kitsunoko and its affiliates, officers, directors, employees, and agents from any claim, liability, damage, loss, or expense (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party right.

Either party may terminate the relationship at any time. You may close your account from account settings. We may suspend or terminate your access immediately if you violate these Terms, if required by law, or if we discontinue the Service.

Upon termination, your right to use the Service ceases immediately. Sections 5, 8, 9, 10, and 13 survive termination.

We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice in the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law provisions. Any dispute arising from these Terms or the Service shall be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm.

You waive any right to participate in a class action lawsuit or class-wide arbitration against Kitsunoko.
